Terms of Service

1. Service Overview

Avatutor provides AI-based educational tools, including avatar-assisted tutoring, voice/text interaction, and interactive whiteboard features. Answers are generated by artificial intelligence systems.

2. Age and Use by Minors

Users under 18 may use the Service only with the consent of a parent or guardian. A paid subscription must be purchased by an adult or with their consent, and the parent or guardian is responsible for the minor's use of the Service.

3. Account

You are responsible for your account credentials and all activity under your account. You must provide accurate information and keep your contact details up to date. Your account is personal and may not be transferred or shared.

4. Trials, Subscriptions, and Billing

The trial is free and requires no payment details; it does not convert into a paid plan automatically. To continue, you subscribe.

Subscriptions are billed in advance at the start of each billing period (monthly unless stated otherwise) and renew automatically each period until cancelled. Charges are handled by our payment provider (PayPal). Displayed prices are final.

5. What Your Subscription Includes

Your subscription includes the features and services available in the app at the time of payment. We may add new features, services, or content in the future that are offered for a separate fee and are not included in an existing subscription, and we may change, improve, or remove features as the service develops.

6. Fair Use

To prevent abuse (such as shared accounts, automated use, or bots), the Service has daily and monthly usage limits. They are set so that a student using the Service normally should not reach them. If you reach a limit you will see a notice, and you can contact us to have it reviewed.

7. Price and Plan Changes

We may change subscription prices and plans. A price change to an existing subscription is made only with advance notice and usually requires your approval through the payment provider. If you do not approve it, the subscription may end at the close of the current billing period, and you can re-subscribe to an active plan.

8. Cancellation and Refunds

You can cancel at any time: in your account in the app, in your PayPal account, or by emailing us. Cancelling stops future charges, and you keep access until the end of the billing period already paid for.

No refund is given for the unused part of a paid billing period, except where the law requires one. In particular, where a right to cancel a distance transaction applies to you under the Israeli Consumer Protection Law, 1981, the refund will be given as the law provides, less the cancellation fee it sets (5% of the price or ₪100, whichever is lower).

9. Suspension and Termination

We may restrict, suspend, or terminate accounts for abuse, fraud, violations of these terms, or technical/security reasons.

10. Acceptable Use

You may not use Avatutor for unlawful activity, abuse, attempted unauthorized access, copying or automated collection of content from the Service, reverse engineering, or harmful content generation. We reserve the right to restrict usage to protect users and systems.

11. Content You Upload

You keep the rights to content you upload or write (questions, images, files, videos). You allow us to use it to provide the Service, including processing it through our AI providers as described in the Privacy Policy. Only upload content you have the right to use, and do not upload other people's personal information.

12. Teachers and Businesses

A teacher or business that builds lessons and courses in the studio is responsible for its content: that they have the right to use it, and that it is not harmful or misleading. They keep the rights to their content and allow us to show it, teach it through the 3D teacher and voice it, to provide the Service. We may review a lesson before it is published, decline to publish it, or remove it.

A teacher who makes a voice of their own may record only their own voice, with their explicit consent. A business that invites people through an invite link sees their progress in its lessons, as described in the Privacy Policy.

The studio is currently free for a limited time. Commercial terms - selling lessons and courses and sharing revenue - will be agreed with each teacher or business separately before they apply.

13. Intellectual Property

The Service, including its software, avatar teachers, voices, design, and the content we create, belongs to us or our licensors. You may not copy, distribute, or use it commercially without our written permission.

14. Disclaimer

Educational content is generated by AI, is provided "as is", and may contain errors. The Service does not replace a teacher, and we do not guarantee success in an exam, a grade, or any particular learning outcome. You are responsible for verifying important results before relying on them.

15. Availability

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service may be unavailable from time to time for maintenance, upgrades, or outages at third-party providers.

16. Limitation of Liability

To the extent permitted by law, we are not liable for indirect, consequential, or special damages arising from use of, or inability to use, the Service, and our total liability will not exceed the amount you paid for the Service in the three months before the event. Nothing here limits rights the law gives you that cannot be waived.

17. Changes to These Terms

We may update these terms from time to time. We will announce material changes on the site or by email, and a change that is unfavorable to an existing subscriber takes effect for them from the next billing period. Continuing to use the Service after an update means you accept the updated terms.

18. Governing Law and Jurisdiction

These terms are governed by the laws of the State of Israel, and the competent courts in Israel have exclusive jurisdiction over any matter relating to them, subject to applicable law.
